NCA to appeal against court’s decision on Lukoil Neftochim Burgas license’s termination


On August 2, 2011 Bulgaria's National Customs Agency filed at the Administrative Court of Sofia two claims against court's decisions No 4,343 and 4,344, which stop the execution of decisions No 527 and 528 of the NCA, dated July 22, 2011, for the termination of the warehouse management licence of Lukoil Neftochim Burgas AD, the press office of the NCA announced.
According to the NCA, the Administrative Court has wrongly accepted that the company has proved the type and the size of the claimed damages, as well as the possibility for their occurrence.
The Administrative Court has set up a thesis over the oil delivery and production contracts presented by the claimant, as well as on over the possible damages the company would suffer from non-observation of these contracts.
If the documents are examined carefully, it turns out that the trader I Lukoil Bulgaria EOOD and Lukoil Neftochim Burgas AD, which is another company and is not a party in the contracts.
The NCA considers that the principle of equality of the parties involved has been violated.
